Department of Labor Grants Limited Exemption from Equal Employment Opportunity Clause

In an effort to provide relief to companies impacted by the COVID-19 pandemic, the U.S. Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) has issued a memorandum that grants a limited exemption and waiver from some of the requirements of the laws administered by the OFCCP. This includes a requirement that federal contracting agencies include an equal opportunity clause in all covered supply and service and construction contracts. The exemption and waiver will be in place for a period of three months, from March 17 to June 17, 2020. It applies only to the three programs administered by OFCCP and should not be interpreted as applicable to any other programs or laws administered by the Department of Labor.
