Former Window Company Owners Federally Indicted for Failing to Pay Taxes

Michael M. Russell and Laurie L. Russell, previous owners, officers and operators of North Country Windows Inc. in Lancaster County, Neb., have been charged in the U.S. District Court for the District of Nebraska in a federal indictment of four counts of failing to pay federal income taxes and income tax withholdings of their employees.

According to court documents during the first quarter of 2006, ending March 31, 2006, the defendants deducted and collected approximately $79,822.21 from the total taxable wages of North Country employees, federal income taxes and Federal Insurance Contributions Act taxes. The documents say that in early May 2006 in the District of Nebraska, the defendants willfully failed to pay over to the Internal Revenue Service (IRS) the federal income taxes and Federal Insurance Contributions Act taxes withheld and due to the United States of America, for the quarter ending March 31, 2006.

According to the documents, during the second quarter of 2006, ending June 30, 2006, the defendants deducted and collected from the total taxable approximately $75,791.40. In July 2006 the defendants again failed to pay the IRS the federal income taxes and Federal Insurance Contributions Act taxes that were due.

In addition, the documents say that during the third quarter of 2006, ending September 30, 2006, defendants again deducted and collected from the total taxable wages approximately $73,603.33 and around October 31, 2006, failed to pay the IRS the federal income taxes and Federal Insurance Contributions Act taxes that were due.

During the fourth quarter of 2006, ending December 31, 2006, the court documents say defendants deducted and collected from the total taxable wages approximately $82,269.27, and, again, failed to pay the IRS.

According to court documents, the United States of America requests that the trial of this case be held in Lincoln, Neb., pursuant to the rules of the court.
